Terms of Service

These terms govern your use of bigshottheory.com and anything you buy from us. Please read them — by placing an order you agree to be bound by them. If you're buying as a consumer (not a business) inside the EU or UK, you keep all rights granted by your local consumer law; nothing here overrides them.
1. Who we are
BST studio s. r. o. (trading as Big Shot Theory) is a Slovak limited-liability company, company ID (IČO) 54663831, with registered seat at Pri vojenskom cintoríne 4093/10, 851 01 Bratislava – mestská časť Petržalka, Slovakia. 2. What we sell
We licence original photography and video produced by our studio. You're buying a right to use the file — the underlying copyright stays with us. The exact rights you get depend on the licence tier you pick at checkout.
3. Account & eligibility
- You must be 16 or older to create an account.
- One person per account. Keep your login credentials private.
- Tell us if you suspect your account has been accessed without permission.
4. Orders & payment
- Payments are processed by Polar, our Merchant of Record.
- Your contract is formed when Polar confirms your payment.
- In the event of a chargeback or payment reversal, all licences granted for the purchased assets are immediately revoked. Continued use of the assets after a refund or chargeback constitutes copyright infringement.
5. Delivery & technical specs
- Files are delivered digitally via a download link.
- Every product page shows technical specifications (resolution, codec, etc.). While we use AI to assist with titles and keywords for search convenience, these do not constitute a legal warranty. The visual preview and technical spec list are the definitive description of the asset. Creative interpretation of AI-generated descriptions is not grounds for a refund.
6. Right of withdrawal (EU consumers)
By completing checkout and clicking the download link, you expressly consent to delivery starting immediately and acknowledge that your right to withdraw is lost once the download begins. If you bought a licence but haven't yet started the download, you have 14 days to request a full refund.
7. Returns & technical guarantee
Outside the withdrawal right above, we operate a 30-day window for technical defects. This guarantee covers file corruption or major discrepancies (e.g., wrong resolution). We cannot refund licences that have already been used in any public-facing material or published campaigns.
8. Acceptable use of the site
- Don't scrape, mirror, or bulk-download our library.
- Don't train machine-learning models or build datasets from our files without a separate written agreement. A Standard or Extended licence does not grant AI-training rights.
- Don't use the site to do anything illegal.
9. Your content (suggestions & feedback)
If you send us feedback or ideas, you grant us a worldwide, royalty-free right to use it to improve the studio without obligation to credit or compensate you.
10. Warranties
We warrant that we own the copyright or have secured necessary rights for the content. Model and property releases are provided where explicitly stated on the asset page. For assets marked as “Editorial,” the user is responsible for obtaining any necessary third-party permissions for commercial use.
The site is provided “as is” without warranty of uninterrupted service.
11. Liability cap
Our total liability for any claim is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €500. This cap applies to the fullest extent permitted by applicable law.
12. Indemnity (for business customers only)
If you use the file outside the permissions granted by your licence and a third party sues us as a result, you'll cover our reasonable legal costs.
13. Suspension & termination
We can suspend or close your account for breaches (licence fraud, scraping, chargeback abuse). Your existing licences stay valid unless terminated due to fraud, in which case the purchase price will be refunded where required by law.
14. Changes & governing law
We may update these terms; material changes will be emailed 30 days in advance.
These terms are governed by the laws of the Slovak Republic. Disputes go to the courts of Bratislava.
EU consumers may also use the European Commission's Online Dispute Resolution platform or their local consumer protection body to settle any disputes.
